1. About PAYPERFEX and This Agreement
These Terms of Use (“Terms”) form a legally binding agreement between you (“you,” “your,” or “User”) and PAYPERFEX sp. z o.o. (“PAYPERFEX,” “we,” “us,” or “our”), governing your access to and use of our website https://payperfex.com and related services (collectively, the “Services”).
PAYPERFEX is a private limited liability company registered under the laws of Poland, with its registered office at ROMANA DMOWSKIEGO, no. 3, room 9, WROCŁAW, POLAND 50-203. Our company operates in accordance with applicable laws and regulatory standards within the European Union and Polish financial and data protection frameworks.
PAYPERFEX facilitates the online exchange of digital currencies (“Digital Currencies” or “DC”) and fiat currencies (“Fiat Currencies” or “FC”) through a secure peer-to-peer platform. We are not a bank or a licensed payment service provider under the Polish Act on Payment Services. Our Services are provided on a non-custodial, intermediary basis unless otherwise expressly stated.
By accessing, registering with, or using the Services in any way—including but not limited to browsing the website, initiating a transaction, or submitting an application—you confirm that you:
- are at least 18 years old,
- possess full legal capacity,
- and have read, understood, and agreed to be bound by these Terms.
If you do not agree to these Terms, you must not use our website or Services. Continuing to use the Services after changes have been made constitutes acceptance of those changes.
These Terms are made available in English and may be translated into other languages for your convenience. In the event of any discrepancies between translated versions and the English version, the English version shall prevail.
PAYPERFEX is committed to maintaining the highest standards of transparency, security, and compliance. We update these Terms from time to time to reflect changes in law, market conditions, or our operations. We will notify you of any material changes at least 30 days in advance, unless the change is made:
- for your benefit,
- to comply with applicable law or regulatory requirements, or
- to improve clarity or accuracy.
2. Our Services
PAYPERFEX provides an online platform that allows users to buy, sell, and trade digital currencies (“DC”) for fiat currencies (“FC”) and vice versa. These services are provided on a non-custodial, peer-to-peer basis and are accessible through our website at https://payperfex.com.
Important: PAYPERFEX is not a bank, financial institution, or licensed payment service provider under Polish or EU law. We do not offer foreign exchange services between fiat currencies (e.g., EUR to USD), nor do we support payments to third parties in FC.
By using the Services, you agree to pay any applicable fees as listed on our Fees page.
2.1 Service Availability
The availability of our Services may vary depending on your country of residence. PAYPERFEX does not provide Services to users in jurisdictions where the provision of such Services would be illegal or restricted. The list of supported countries is provided during account registration.
2.2 No Guarantee of Service Continuity
While we strive to ensure uninterrupted access to our platform, PAYPERFEX does not guarantee the continuous or error-free operation of its Services. Temporary outages may occur due to maintenance, upgrades, technical issues, or regulatory compliance.
2.3 Our Commitments
Subject to these Terms, we agree to provide the Services with reasonable care and skill. However, we reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, particularly to ensure compliance with applicable law or internal risk policies.
3. Account Opening
To access and use our Services, you must first create an account with PAYPERFEX by completing the registration process on our website.
3.1 Eligibility and Verification
During registration, you must provide accurate and complete personal or corporate information. This may include, but is not limited to:
- Full name and date of birth
- Residential address and nationality
- Valid government-issued ID, including type, number, issuing country, and expiry date
- For legal entities: company name, seat, registration number, and directors
We may verify your identity using third-party services and databases. By registering, you consent to such verification and agree to provide any additional documentation we reasonably request to comply with anti-money laundering (AML), counter-terrorism financing (CTF), and other legal obligations.
3.2 Account Approval and Rejection
We reserve the right to approve or reject any account application at our sole discretion. We are under no obligation to disclose the reasons for a refusal. You are not permitted to use our Services until your account is fully verified and approved.
3.3 Ongoing Monitoring
After approval, your account may be subject to additional verification or review if you reach certain trading, deposit, or withdrawal thresholds, or if we detect suspicious activity. You agree to cooperate with any such request for further information.
3.4 Account Suspension
We may suspend or restrict your account at any time to comply with legal or regulatory requirements, protect the security of the platform, or assess risk. During a suspension, trading or withdrawals may be temporarily unavailable.
3.5 Delisting of Funds
PAYPERFEX reserves the right to delist any DC or FC from the platform. Affected users will be notified in advance with a deadline to withdraw such funds. After the deadline, withdrawals may be subject to a special administrative fee, the amount of which will be determined and communicated individually.
3.6 Unverified or Inactive Accounts
We may terminate or delete accounts that remain unverified despite reasonable attempts to contact you. Any remaining balances may be forfeited or subject to a return fee, in accordance with applicable regulations.
4. Deposits
You may deposit either Fiat Currency (FC) or Digital Currency (DC) into your PAYPERFEX account using the methods supported on our platform. All deposits must comply with the conditions outlined below.
4.1 Deposit Methods
You can deposit FC via bank transfer or through regulated third-party payment service providers. Available methods may vary by country and are listed on our Fees and Funding Methods page. Deposit methods are subject to change without prior notice.
4.2 Reference and Account Matching
When depositing funds, you must include any required reference or payment ID so we can correctly allocate the funds to your account. Deposits without a valid reference may be delayed or rejected.
4.3 Third-Party Payments
All FC deposits must come from a bank account or payment instrument in your name. Deposits made from third-party accounts will be rejected and returned, subject to an administrative fee. Refunds may take up to two business days.
4.4 Deposits via Payment Partners
When using our third-party payment partners, your FC will be held in segregated customer accounts maintained by those providers in accordance with applicable financial regulations. You authorize PAYPERFEX and its partners to process your funds as necessary to credit your trading account.
4.5 Legal Classification of Funds
Funds deposited for the purpose of buying DC do not constitute bank deposits, electronic money, or payment instruments under Polish or EU law. They are treated solely as funds intended for exchange transactions.
4.6 Digital Currency Deposits
When depositing DC, you must ensure that the source of the funds is lawful. We may request proof of origin for any DC deposit and reserve the right to suspend your account if the source appears suspicious or unverifiable.
4.7 Use of Joint Accounts
If you intend to deposit funds from a joint account, you must notify us in advance. We reserve the right to request identity verification of all account holders and may refuse deposits if such verification is not completed to our satisfaction.
4.8 Deposit Fees
Deposit fees are clearly stated on our platform and will be deducted from the total amount received. The net amount will be credited to your PAYPERFEX trading account in the same currency.
4.9 Rejected or Incorrect Deposits
Incorrect or non-compliant deposits (e.g. wrong currency, invalid reference, unauthorized source) may be returned at your expense. PAYPERFEX is not liable for losses resulting from such deposit errors.
5. Trading
PAYPERFEX offers a trading platform where you may place buy or sell orders to exchange Digital Currencies (DC) and Fiat Currencies (FC). By using our trading services, you agree to the rules outlined below and accept all associated risks.
5.1 Types of Orders
You may submit different types of orders through the platform:
- Limit Order: You set the price at which you wish to buy or sell. The order may be partially or fully matched over time, depending on market liquidity.
- Market Order: You specify the amount you want to trade, and we match it instantly with the best available counteroffers in the market. Market Orders may execute at prices higher or lower than expected, based on available liquidity.
- Quick Order: A simplified trading option where you enter the amount, and PAYPERFEX executes the order on your behalf using the best available rate (including spread, fees, and any conversion margin). These orders may use external markets and are subject to availability.
5.2 Instant FC to DC Conversions
If you choose to convert Fiat Currency into Digital Currency via card payment (“FC to DC Conversion”), the transaction becomes final once authorized. After confirmation of payment, the purchased DC will be credited to your wallet within 24 hours. All conversions are irreversible and cannot be canceled once submitted.
5.3 Trading Conditions and Restrictions
- You may only trade if you have a sufficient balance to cover both the trade amount and any applicable fees.
- Quick Orders become final and non-cancellable upon your confirmation of the exchange rate.
- Orders may be withdrawn or canceled prior to execution unless otherwise stated. Partially filled orders can be canceled for the remaining amount.
- If your account is suspended, all pending orders will be canceled immediately.
5.4 Price Volatility and Market Risk
Digital Currency markets are volatile. Instant or Quick Orders may be executed at a price that differs significantly from what you expect. By placing any type of order, you acknowledge and accept these risks.
5.5 Order Matching and Settlement
When your order is matched, you will receive a settlement report with transaction details. You will not know the identity of the counterparty.
5.6 Order Cancellation by PAYPERFEX
We reserve the right to cancel or retract an order if it is considered suspicious, appears to involve market manipulation, or constitutes a “Mistrade” (e.g., an order executed at a clearly incorrect price due to system error or outdated market data). In such cases, we will notify you and refund any associated funds promptly.
6. Recurring Buy
PAYPERFEX offers a Recurring Buy feature, allowing you to automatically purchase Digital Currency (DC) using a standing bank order in Euros. This is a convenient way to accumulate DC over time without manual intervention.
6.1 How It Works
You must set up a standing order with your bank to send EUR funds to the PAYPERFEX account details provided in your user dashboard. Upon receipt of funds, PAYPERFEX will automatically execute a DC purchase and credit your account accordingly.
6.2 Execution Time
We aim to complete Recurring Buys within 24 hours of receiving your payment, provided all necessary information has been submitted correctly. Market volatility may affect the final execution rate. PAYPERFEX is not responsible for any change in DC value between the time of deposit and execution.
6.3 Account Ownership Requirement
Funds must originate from a bank account held in your name. Payments from third-party or joint accounts without prior notification may be rejected or delayed.
6.4 Limits
The minimum amount for a Recurring Buy is 50 EUR. The maximum is subject to your account’s individual deposit and withdrawal limits, as shown in your account settings.
6.5 Currency Restriction
Recurring Buy transactions are currently only available in EUR.
6.6 Cancellation
You may cancel a Recurring Buy at any time by stopping the standing order in your online banking. No further purchases will occur unless new funds are received.
6.7 Multiple Recurring Buys
If you wish to set up Recurring Buys for multiple Digital Currencies, you must repeat the setup process for each one. Be sure to follow the individual instructions displayed in your PAYPERFEX account for each selected DC.
6.8 Responsibility for Accuracy
You are responsible for ensuring that all payment instructions—including bank account details, reference codes, and frequency—are correctly entered when setting up the standing order. PAYPERFEX is not liable for missed or failed Recurring Buys due to user error or incomplete instructions.
7. Withdrawals
You may withdraw Fiat Currency (FC) or Digital Currency (DC) from your PAYPERFEX account at any time, subject to availability and compliance with applicable laws and platform policies.
7.1 Withdrawal Methods and Timing
Withdrawals can be made using the available methods listed on our platform. Processing times may vary depending on the method chosen:
- Bank transfers: May take 1–5 business days depending on your location and the receiving institution.
- DC withdrawals: Most are processed instantly, but may take up to 48 hours in certain cases for security or operational reasons.
7.2 Withdrawing Fiat Currency
When you request an FC withdrawal, the funds will be sent from a pooled account held by PAYPERFEX or our authorized payment partners. The withdrawal amount and any applicable fees will be deducted from your account balance in the same currency.
7.3 Withdrawing Digital Currency
Withdrawals of DC will be sent to the wallet address you specify at the time of the request. You are solely responsible for ensuring that the destination address is accurate and valid for the type of cryptocurrency being withdrawn. Blockchain transactions are irreversible, and PAYPERFEX is not responsible for funds lost due to user error or incorrect wallet information.
7.4 Withdrawal Fees
All withdrawals are subject to fees as outlined on our Fees page. You are responsible for paying any network, intermediary, or banking charges that may apply. These will be deducted from your withdrawal amount before transfer.
7.5 Temporary Restrictions
In some cases—such as trades involving low-liquidity DCs or externally sourced liquidity—there may be temporary restrictions on withdrawing certain funds. These limitations will be clearly disclosed before you confirm the trade. You will still be able to trade or convert the DC within the platform during any restriction period.
7.6 Compliance and Fraud Prevention
We may delay, suspend, or cancel withdrawal requests in the following cases:
- Pending verification or suspicious activity on your account
- Compliance with AML/CTF or other regulatory requirements
- Risk of fraud, unauthorized access, or errors in payment information
You will be notified if your withdrawal is delayed or requires further verification.
8. Limits
To ensure regulatory compliance, security, and operational efficiency, PAYPERFEX applies certain limits to account activity. These limits may vary depending on your verification level, transaction history, and other risk factors.
8.1 Types of Limits
The following limits may apply to your account:
- Deposit Limits: Maximum allowable amount of Fiat or Digital Currency that can be deposited within a 24-hour period.
- Withdrawal Limits: Maximum allowable amount that can be withdrawn within a given time frame (e.g., daily or monthly).
- Trading Limits: Restrictions on the size or frequency of trades based on account status or market conditions.
8.2 Holding Periods
Certain deposits or withdrawals may be subject to a holding period—a specified time during which the transaction is held for review before being processed. Holding periods are typically applied in cases of high-risk activity, large transactions, or funding via new or unverified payment methods.
8.3 Adjustments to Limits
We reserve the right to adjust your limits at any time, including lowering or increasing them based on internal risk assessments, regulatory updates, or your account behaviour. You may request a limit increase by submitting a support request along with any required verification documents.
8.4 Real-Time Visibility
Your current limits and remaining allowances are visible in your account dashboard. It is your responsibility to review and understand these limits before initiating transactions.
9. Commission (Referral Program)
PAYPERFEX offers a referral program that rewards registered users (“Referrers”) who introduce new clients to our platform. By participating in the referral program, you agree to the terms set out below.
9.1 Earning Commission
As a Referrer, you will receive a unique referral link to share with prospective users (“Prospective Clients”). If a Prospective Client signs up using your link and becomes a verified client (“New Client”), you may earn a commission on PAYPERFEX’s net income from that client’s trading activity for a limited period.
The default commission rate is 5% of net trading fees paid by the New Client for up to six (6) months following their registration. Net income excludes VAT, rebates, and operational expenses.
9.2 Referrer Obligations
By participating in the referral program, you agree to:
- Act in good faith and promote PAYPERFEX ethically and lawfully
- Not create fake or duplicate accounts to generate commission
- Not misrepresent your relationship with PAYPERFEX
- Comply with anti-bribery and anti-spam laws
- Only promote PAYPERFEX on platforms that meet our Acceptable Use Policy
We may request full disclosure of where and how your referral link is being used. You must cooperate within seven (7) days of such request. PAYPERFEX reserves the right to revoke or limit referral access at any time without notice.
9.3 Payment Terms
- Commissions are paid only after we receive the corresponding fees from the New Client.
- We aim to pay commissions within a reasonable timeframe, subject to administrative processing.
- You are responsible for any tax obligations on commissions received.
- If you are VAT registered, an invoice may be required before payment.
9.4 Discretionary Bonuses
PAYPERFEX may introduce other incentive programs or trader bonuses at its sole discretion. Participation in such programs does not create a legal entitlement to future benefits or payments.
9.5 Breach of Referral Terms
If you breach the conditions in this section, all accrued and future commissions may be forfeited. If commissions have already been paid out, PAYPERFEX may seek reimbursement and take legal action if necessary.
10. Wallet
All Digital Currencies (DC) associated with your PAYPERFEX account are stored in wallets controlled and maintained by PAYPERFEX. These wallets are necessary to facilitate trading, settlement, and withdrawals on the platform.
10.1 Custody and Control
PAYPERFEX retains full control over the private keys and security infrastructure associated with user wallets. You acknowledge and agree that this is essential for trade execution, risk management, and platform integrity. You do not have direct access to private keys or on-chain wallet management features.
10.2 Hot and Cold Wallets
To balance accessibility and security, we operate a tiered storage system:
- Hot Wallets: Used for real-time processing of deposits, withdrawals, and trades. Only a small portion of total assets is stored here to limit exposure.
- Cold Wallets: The majority of DC is stored offline in geographically distributed, encrypted cold storage systems to safeguard against hacks and system failures.
10.3 Segregation of Funds
Although DCs are stored in pooled wallets, we maintain internal ledgers that accurately track user balances at all times. These records are strictly monitored and reconciled.
10.4 No Interest or Earnings
Your wallet is provided for transactional purposes only. PAYPERFEX does not pay interest or generate yield on DC held in your wallet unless explicitly stated in a separate product offering.
10.5 Suspension and Access Limitations
In cases of account suspension, suspected fraud, or regulatory investigation, access to your wallet may be temporarily restricted until the matter is resolved. This is necessary to comply with legal obligations and protect user funds.
11. Risks
By using the PAYPERFEX platform, you acknowledge and accept that trading or holding Digital Currencies (DC) carries inherent risks. You agree that you understand these risks and that you are solely responsible for any decisions made when using our Services.
11.1 Market Volatility
DC values can fluctuate significantly in short periods of time. Prices may rise or fall rapidly and without warning, leading to substantial losses. Trading or storing DC is not suitable for all users and should only be undertaken with funds you can afford to lose.
11.2 Irreversible Transactions
All DC transactions are final and irreversible once confirmed. If you send funds to the wrong wallet address, they cannot be recovered. PAYPERFEX is not responsible for losses due to user error or misdirected transactions.
11.3 Lack of Regulation
DCs are not legal tender and are not backed by any government or central bank. They operate on decentralized, unregulated networks that may be susceptible to manipulation, failure, or collapse. Our Services are not currently regulated under Polish financial services law.
11.4 Technology Risks
DCs rely on blockchain and peer-to-peer networking protocols. These technologies may be vulnerable to software bugs, hacking, delays, and changes imposed by developers or communities. Technical problems may result in financial loss, delayed transactions, or loss of access to funds.
11.5 Confidence and Systemic Risk
The value of DCs depends on market confidence. This confidence can be affected by regulatory actions, competing technologies, security breaches, or shifts in public perception. A collapse in confidence may render certain DCs worthless or untradeable.
11.6 Regulatory Uncertainty
Changes in laws or regulations—particularly in your country of residence—may impact your ability to use or trade DCs on our platform. We may be required to restrict, modify, or suspend our Services in response to regulatory developments without prior notice.
11.7 No Guarantee or Compensation
PAYPERFEX does not guarantee the value, stability, or usability of any DC offered through our platform. You agree not to hold PAYPERFEX liable for any losses, damages, or claims resulting from market behavior, system performance, or third-party actions.
11.8 Unforeseen Risks
This section does not list every possible risk. There may be additional risks arising from emerging technologies, regulatory environments, or unforeseeable events. You are strongly encouraged to conduct independent research and consult with financial professionals before engaging in DC trading.
12. Your Obligations
By registering with PAYPERFEX and using our Services, you agree to comply with these Terms, applicable laws, and the standards of good conduct expected on our platform. You are responsible for your actions and the information you provide.
12.1 Accurate Information
You must provide complete, truthful, and current personal or business details during registration and verification. You are responsible for updating this information if it changes. If requested, you must provide additional documents to verify your identity or account status.
12.2 Politically Exposed Persons and Compliance
If you become a Politically Exposed Person (PEP) or subject to sanctions or adverse media, you must notify PAYPERFEX immediately. We reserve the right to perform enhanced due diligence and may apply special compliance fees where applicable.
12.3 Transaction Accuracy
You are responsible for ensuring that all deposit, trade, and withdrawal instructions are accurate before submission. DC transactions are irreversible. PAYPERFEX is not liable for user mistakes, including sending funds to incorrect wallet addresses.
12.4 Lawful Use
You must not use the platform for any unlawful purpose, including but not limited to fraud, money laundering, terrorism financing, or circumventing capital controls. PAYPERFEX may report suspicious activity to law enforcement or regulatory authorities.
12.5 Prohibited Conduct
You agree not to:
- Open more than one account without permission
- Provide false or misleading information
- Allow others to use your account
- Refuse to cooperate with investigations or verification requests
- Use anonymizing proxies or tools to mask identity or activity
- Engage in manipulative trading practices (e.g., spoofing, wash trading, pump and dump)
12.6 Taxes
You are solely responsible for reporting and paying any taxes arising from your use of the Services. PAYPERFEX does not provide tax advice.
12.7 Transaction Monitoring
We may request further information in accordance with applicable law, including Regulation (EU) 2023/1113. Failure to provide requested details may result in the suspension or cancellation of your transactions.
13. Liability
13.1 Exclusions of Liability
To the extent permitted by law, PAYPERFEX is not liable for:
- Failure to match or process your order due to technical issues or market conditions
- Delays or failures caused by third-party service providers
- Transmission errors, internet failures, or browser incompatibilities
- Loss of funds due to incorrect information provided by you or a third party
- Malfunctions or interruptions outside our reasonable control
13.2 Order Cancellation
We may delay or cancel an order prior to settlement for reasons including but not limited to:
- Identity or payment verification
- Lack of market liquidity
- Technical failures
- Severe exchange rate movements
- Mistrades (e.g., orders executed at erroneous prices)
- User failure to follow order instructions (e.g., missing payment references)
In such cases, we will refund any affected funds without undue delay, but will not be liable for direct or indirect losses.
13.3 Service Interruptions
We do not guarantee continuous availability of our website or Services. We may suspend or withdraw access at any time without liability.
13.4 Third-Party Charges
PAYPERFEX is not responsible for fees charged by your bank or payment provider, including overdraft or network fees.
13.5 Limitation of Liability
Unless otherwise agreed in writing, our liability to you is limited to the greater of:
- EUR 500, or
- The total amount of fees you paid to PAYPERFEX in connection with the disputed transaction.
13.6 Exclusions
Nothing in these Terms shall exclude or limit our liability for death or personal injury resulting from our negligence, or for fraud or fraudulent misrepresentation.
13.7 Indemnity
You agree to indemnify and hold PAYPERFEX and its affiliates harmless from any claims, losses, liabilities, costs, or damages arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
14. Electronic Communications
By using the PAYPERFEX platform, you consent to receive all communications from us electronically. This includes but is not limited to: agreements, notices, disclosures, policies, updates, and any other information related to your use of the Services.
14.1 Binding Nature of Electronic Communications
These Terms, and any other agreements entered into between you and PAYPERFEX, are legally binding and enforceable in electronic form. You agree that electronic signatures, records, and disclosures carry the same legal weight as their paper counterparts under applicable law.
14.2 Paperless Relationship
Our Services are delivered exclusively online. We do not provide paper copies of communications. If you require a record, you should download or print documents from your account interface.
14.3 Technical Requirements
To access and retain electronic communications, you must have:
- A device with internet connectivity
- A compatible browser with 128-bit encryption support (e.g., Mozilla Firefox v30.0+, Google Chrome v30.0+)
- An active email account capable of receiving messages from PAYPERFEX
- Storage space to save or print communications for your records
14.4 Delivery of Communications
All communications will be considered delivered once sent to your registered email address or made available via your account dashboard. It is your responsibility to ensure your contact information is up to date and that you regularly monitor these channels.
15. Investigation
PAYPERFEX reserves the right to investigate any account activity that appears to violate these Terms, relevant laws, or our internal compliance standards. We may take immediate action to protect the platform, users, and regulatory interests.
15.1 Grounds for Investigation
We may initiate an investigation for any reason, including but not limited to:
- Suspicious or unusual transaction activity
- Potential fraud or account compromise
- Violation of anti-money laundering (AML) or counter-terrorism financing (CTF) obligations
- Breaches of these Terms or any applicable law
15.2 Account Suspension During Review
During an investigation, we may suspend access to your account, freeze assets, or delay processing of withdrawals. These measures are taken to prevent harm, maintain system integrity, and comply with applicable law.
15.3 Requests for Documentation
We may request additional information or documentation to complete our investigation. You agree to cooperate fully and provide all requested materials in a timely and accurate manner. This may include identity documents, proof of funds, source of wealth, or explanations for specific transactions.
15.4 No Obligation to Release Funds
PAYPERFEX is under no obligation to release any funds or allow continued use of the Services during an ongoing investigation. Access may be restricted until the matter is resolved to our satisfaction or in accordance with regulatory requirements.
15.5 Outcomes
Upon conclusion of an investigation, we may take one or more of the following actions:
- Lift restrictions and restore full access to your account
- Report findings to law enforcement or regulators
- Terminate your account under Section 26
- Confiscate or return funds, where required by law
We are not liable for any losses or damages you may incur as a result of actions taken during or after an investigation, provided such actions were conducted in good faith and in accordance with applicable law.
16. Intellectual Property
All intellectual property rights related to the PAYPERFEX website, Services, and associated content—including but not limited to software, logos, trademarks, design elements, databases, text, and graphics—are the exclusive property of PAYPERFEX or its licensors.
16.1 Ownership
Nothing in these Terms grants you any rights, title, or interest in the intellectual property of PAYPERFEX, other than a limited, non-exclusive, revocable license to use the Services for their intended purpose under these Terms.

You may not, without prior written consent from PAYPERFEX:
- Modify, reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Services
- Create derivative works from the content or software
- Use PAYPERFEX trademarks or branding in a misleading or unauthorized manner
- Reverse engineer, decompile, or attempt to extract the source code of the platform
16.3 Infringement Reporting
If you believe your intellectual property rights have been violated on the PAYPERFEX platform, please contact us through the support form with sufficient detail to evaluate your claim.
17. Data Protection and Privacy
PAYPERFEX is committed to protecting your personal data in compliance with the General Data Protection Regulation (GDPR) and applicable Polish data protection laws.

18. Support Interface
To ensure the privacy and integrity of your account information, PAYPERFEX provides a secure Support Interface available only through your authenticated user account. All sensitive communications must be conducted through this channel.
18.1 Secure Communication
You must use the Support Interface for all requests involving account details, trading activity, deposits, withdrawals, verification, or changes to account settings. This is the only channel through which we will handle sensitive or confidential information.
18.2 Prohibited Channels
We do not respond to support requests involving personal or account-sensitive data via email, social media, or other public or unsecured platforms. PAYPERFEX is not responsible for any breach of data security or unauthorized access resulting from the use of inappropriate communication channels.
18.3 Lost Credentials
If you are unable to access your account due to lost login credentials, you may initiate a password recovery request via the login page. We may require identity verification documents to confirm account ownership before reactivating access.
18.4 Response Time

20. Nicknames and Avatars
As part of your PAYPERFEX profile, you may choose a public nickname and optional avatar image to personalize your experience.
20.1 Nicknames
When you sign up, you’ll receive a default nickname (e.g., PAYPERFEX_0001
). You can change this in your account settings. Your nickname must be unique and must not include offensive, inappropriate, or misleading language.
20.2 Avatars
You may upload an avatar image. Avatars must not contain hate speech, explicit content, copyrighted material, or any images that violate our community standards. Inappropriate avatars will be removed, and repeat offenses may result in account suspension.
20.3 Public Visibility
Nicknames and avatars may be publicly visible in platform features such as leaderboards, referral lists, or chat (if enabled). Choose identifying content you are comfortable sharing.
21. Security
Keeping your PAYPERFEX account secure is your responsibility. We take extensive measures to protect your data and funds, but your cooperation is essential.
21.1 Account Credentials
You are responsible for maintaining the confidentiality of your login details, including your password and any two-factor authentication (2FA) methods. Do not share your credentials with anyone.
21.2 Two-Factor Authentication (2FA)
We strongly recommend enabling 2FA (such as Google Authenticator) in your account settings. This provides an extra layer of protection beyond your password.
21.3 Recommended Security Practices
- Use a strong, unique password for PAYPERFEX (do not reuse passwords from other services)
- Access your email and PAYPERFEX accounts from separate devices, where possible
- Regularly scan your device for malware and viruses
- Do not log in on public or shared computers
21.4 Unauthorized Access
If you suspect your account has been compromised, contact us immediately via the support form. We may request identification documents to verify ownership before taking action.
21.5 Limitations of Liability
PAYPERFEX is not responsible for any unauthorized access, withdrawals, or changes to your account if caused by your failure to implement proper security measures. This includes weak passwords, shared credentials, or compromised devices.
22. API Use
PAYPERFEX provides an optional API (Application Programming Interface) for users who wish to programmatically access their account functions, including trading and (if enabled) withdrawals.
22.1 Enabling the API
By default, API access is disabled. You may enable it manually through your account settings. API permissions are divided into tiers, such as:
- Read and Trade Access: Allows you to view market data and place trades remotely
- Withdrawal Access: Allows remote execution of withdrawals
Each change to API settings requires confirmation through email or two-factor authentication (2FA).
22.2 Security Risks
Enabling API access increases your account’s exposure to automated threats. If your API credentials are compromised, unauthorized actions may be executed without additional verification.
22.3 User Responsibility
You must:
- Keep your API keys confidential and stored securely
- Revoke or rotate your API keys if you suspect a breach
- Use secure, trusted applications or scripts when interfacing with the API
PAYPERFEX is not responsible for losses or damages resulting from misuse or unauthorized access through the API.
22.4 Use at Your Own Risk
API access is provided “as is.” By enabling it, you acknowledge that you are assuming full responsibility for the associated security and operational risks. Use is entirely at your own discretion.
23. Complaints
At PAYPERFEX, we take user satisfaction seriously and are committed to resolving any issues promptly and fairly.
23.1 How to File a Complaint
If you have a complaint about our Services, please submit it in writing via the secure Support Form in your logged-in account. Include a clear description of the issue and any relevant documentation.
23.2 Acknowledgement and Response
We will acknowledge receipt of your complaint within 2 business days. Our team will investigate and provide a resolution or update within 7 business days. More complex cases may require additional time, but we aim to resolve all complaints within 30 days from receipt.
23.3 Consumer Rights
These Terms and all complaints are governed by the laws of Poland. If you are a consumer, you may also have the right to pursue complaints through the national consumer protection framework. This includes contacting the appropriate authority or dispute resolution body in your jurisdiction.
23.4 Legal Framework
All warranty and claims rights arising from defective service performance are governed by Polish law, including the Polish Civil Code and the Act on Consumer Rights. Claims must be submitted within 15 business days of the issue arising.
24. Termination
Either you or PAYPERFEX may terminate this agreement at any time, subject to the conditions outlined below.
24.1 Termination by You
You may terminate your account and this agreement at any time by submitting a request through the Support Form. Before closure, you must:
- Withdraw any remaining fiat or cryptocurrency balances
- Settle any outstanding obligations
24.2 Termination by PAYPERFEX
We may suspend or terminate your account with or without notice if:
- You breach these Terms or applicable law
- You engage in abusive, fraudulent, or harmful behavior toward PAYPERFEX, our staff, or other users
- Your account activity raises legal, compliance, or reputational risks
- You attempt to circumvent our verification or security processes
- Your account has been inactive and unverified despite repeated attempts to contact you
24.3 Immediate Termination for Cause
We reserve the right to terminate your account immediately, without prior notice, in cases of serious violations, such as:
- Use of the platform for illegal activity
- Attempting to breach platform security
- Submitting fraudulent documentation or identity
24.4 Effect of Termination
Upon termination:
- Your access to the platform will be revoked
- You must immediately stop using the Services
- Any remaining funds, if legally permissible, will be returned to you after verification
We reserve the right to retain certain records and data as required by applicable law or regulation.
25. Consumer Rights (EU)
As a consumer residing in the European Union, you may have statutory rights under the EU Consumer Rights Directive (Directive 2011/83/EU), transposed into national law. These include the right to withdraw from certain types of contracts entered into online or at a distance.
25.1 Right of Withdrawal
You have the right to withdraw from any eligible service contract within 14 calendar days from the day after entering into the agreement, without giving any reason. To exercise this right, you must notify PAYPERFEX via the Support Form in a clear, written statement.
25.2 Exceptions to the Right of Withdrawal
Pursuant to Article 16 of the Directive and corresponding national legislation, the right of withdrawal does not apply in the following cases:
- Fully executed services: If the service has been fully performed with your prior express consent and acknowledgment that you waive your right of withdrawal upon full performance.
- Price-dependent services: Where the value of the service depends on financial market fluctuations beyond our control, including cryptocurrency exchange services.
- Digital content: If the service involves the provision of digital content not supplied on a tangible medium, initiated with your express consent.
25.3 Express Waiver of Withdrawal
By using PAYPERFEX to initiate any cryptocurrency purchase, trade, or transfer, you expressly request that the service be executed immediately and acknowledge that, upon full performance, you lose the right to withdraw. This waiver is legally binding under applicable EU and Polish law.
25.4 Withdrawal from Other Services
If you request a withdrawal for any ancillary service not covered by the exceptions above, you must do so within 14 days of the agreement. You may use the standard withdrawal form provided upon request. Once we receive your valid notice, both parties must cease the provision of services and return any received consideration, including applicable interest, within the statutory timeframes.
26. Final Terms
26.1 Entire Agreement
These Terms, along with our Privacy Policy and any other referenced documents, constitute the entire agreement between you and PAYPERFEX regarding your use of the Services. They supersede any prior agreements, communications, or understandings.
26.2 Assignment
We may assign or transfer our rights and obligations under these Terms to another entity without your prior consent, provided that such transfer does not negatively affect your rights. You may not assign or transfer your rights under these Terms without our written approval.
26.3 Third-Party Rights
These Terms do not create any third-party beneficiary rights. Only you and PAYPERFEX have the right to enforce them.
26.4 Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
26.5 No Waiver
Failure by PAYPERFEX to enforce any provision of these Terms shall not be deemed a waiver of our right to do so in the future.
26.6 Force Majeure
We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control ("Force Majeure Events"). These include, but are not limited to: natural disasters, war, acts of terrorism, civil unrest, labor disputes, disruptions in telecommunications or internet access, or actions by governmental authorities. Our obligations will be suspended for the duration of such events.
26.7 Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Poland. Any disputes or claims arising from or related to these Terms shall fall under the exclusive jurisdiction of the competent courts in Poland.
26.8 Alternative Dispute Resolution
If you are a consumer, you may be entitled to seek resolution through an out-of-court settlement process. This includes contacting an Alternative Dispute Resolution (ADR) body such as the Polish Office of Competition and Consumer Protection (UOKiK), or using the EU Online Dispute Resolution (ODR) Platform.
